Your Contract
with SkyValue
1. Bookings and
Payments
Requirements to reserve your air travel or
vacation package: A signed booking form and payment of applicable
fare per person. SkyValue reserves the right to treat the
booking as canceled by you if the balance due is not paid on
time. SkyValue reserves the right to issue airline tickets
once the booking is made and the applicable fare is
received.
2. Changes and Cancellations For Air
Transportation
If you cancel your trip (or change your
departure date, length of stay, class
of service, name or hotel), the below
charges will apply.
Penalties: Charge is per
person.
For
Air only Changes and Cancellations, the following penalties will
apply. Changes at any time are subject to a $50.00 change fee, per
person per change plus the difference in the original fare paid to
the new fare issued. Cancellations at any time, fare is 100%
non-refundable.
3.
Airline Responsibility
SkyValue issues tickets and coupons covering air transportation. SkyValue or its
respective sub-agents, shall not be held liable for loss or damage to
property or injury of person caused by reason of any
defect, negligence, or other wrongful act or omission
by any other transportation company or party providing
such services or facilities, strike, war, terrorism, weather, quarantine,
sickness, government restrictions or regulations, or any other cause beyond its
reasonable control. SkyValue is not liable for any claim arising out of
or in connection with carriage or other services or
features otherwise performed or occurring in connection with this trip, except
as provided in the conditions of carriage for the
passenger tickets issued in conjunction with this trip. SkyValue is
not responsible under any circumstances for any bodily or
emotional injury you may suffer in connection
with your air transportation.
4.
Luggage and Personal Property
When
you fly to and from your destination the Conditions of Carriage
apply, some of which limit or exclude liability. The Conditions of
Carriage are available by requesting them in writing from the
carrier or by request at the airport. Damage to soft-sided luggage
may not be covered. SkyValue’s maximum liability for loss, damage or
delay to checked baggage is limited to $1250 per ticketed passenger.
This limit will apply unless an excess valuation is declared at the
time of check-in. All lost or damaged luggage must be reported to
the airline at the time of the incident and before you leave the
airport. SkyValue does not accept liability for client luggage or
personal property.
5.
Forum Selection Clause
All trips are subject to the terms and conditions shown on
SkyValue’s Tour Participant Operators Contract. Your booking on
SkyValue is acceptance of the terms in the contract, including the
procedure for resolution of disputes which must take place in the
State of Florida.
6.
Choice of Law
This
contract is subject to Florida Law.
Our
Guarantee
1.
Price Guarantee
Our intention is to provide the air travel you
have selected, at the price in effect at time of
booking.
2.
Flight Information
Your travel agent
will be able to confirm the latest flight details at the time
you make your reservation, and these will also appear on the
booking confirmation we issue when we receive your payment for air travel.
Your flight tickets will be sent prior to departure, and will
contain your flight information. All times are subject to change.
SkyValue assumes no responsibility for any passengers making
independent connections to our flights. Air only tickets may be
purchased via the flyskyvalue website or your local travel agent
booking the carrier code XP.
3.
Changes & Cancellation
In the unlikely event
that a major change involving a change of hotel, travel
dates, departure city or destination becomes necessary, we will notify
you as soon as possible. If you find the
revised arrangements we offer unacceptable, you will have the option to
cancel without penalty, provided that you notify us within seven days of
your receipt of notice of the change (or prior to departure date
if notified less than seven days prior). In the event of a change, we
will try to substitute comparable services, but in the
event of complete cancellation by us, our only liability will be to
refund all monies paid (public charters only) or provide a refund in
the form of a SkyValue credit.
4.
Refunds
Any
refunds due you will be made as soon as possible. Please note,
however, that no refunds will be made for any services provided in
the itinerary that you do not use. Refunds (if applicable) for air
programs must be issued upon the return of the unused ticket. If
SkyValue bookings are made by your travel agent then all communications
prior to your departure, including payment and refund transactions,
must be via your travel agent. If for any reason you should lose
your airline paper ticket, you will have to purchase a new ticket at
your own expense and upon your return home, you must contact your
travel agent to begin refund procedures by completing a "Lost Ticket
Application" (fees may apply). Any refunds made by the airline will
be based on the value of the original ticket issued less any airline
processing fees. In most cases, the replacement ticket you have to
purchase will be more expensive.
5.
Pets
Fully weaned dogs or cats at least eight weeks old and
domesticated household birds (canaries, finches, parakeets) can travel with
you in the cabin if they are small enough to fit and stay comfortably
in a container under the seat. Tropical birds such as parrots are not
allowed. (Exception: certified guide dogs).
6. Our
Commitment To You
SkyValue has
taken all reasonable steps to ensure that proper arrangements have been
made for your air travel. Please understand that we cannot control
and will not be responsible for such factors
as weather, government actions, terrorism, mechanical breakdowns, your physical,
medical or mental disabilities, your failure to obtain valid travel
documents or your failure to follow travel instructions. SkyValue is
not responsible for losses or damages arising from bodily or
emotional injury, property or other economic damage caused by factors
beyond our control. SkyValue is not responsible for bodily,
emotional or consequential damages or monetary losses
due to flight delays, airline turbulence, transportation accidents or other
unforeseen circumstances. All prices and features described herein (as well
as in SkyValue's website) are subject to change without notice. If
any term or provision of this Contract is held invalid or otherwise
unenforceable, the enforceability of the remaining terms or
provisions will not be impaired thereby.
7.
Handicapped Facilities
SkyValue does not guarantee the
availability of wheelchairs at any airport.
8. Security
Agreement:
All
payments received by the Operator for this tour are protected in
part by a Standby Letter of Credit issued by National City Bank of
the Midwest (“Bank”). Claims must be filed directly with the
Operator and Bank or if the Operator is unavailable with Bank,
Attention Travel Division, National City Bank of the Midwest, Travel
Division, 1001 South Worth, Birmingham, MI 48009 within 60 days
after completion of the trip. Otherwise, the Bank and the Operator
shall be released from all liability to you.
